General Terms of Use and Privacy Policy

Purpose

The site, available at the address HTTPS://LINK.UNIVCOTEDAZUR.FR, is a private professional social network provided by UNIVERSITÉ CÔTE D’AZUR to allow its members (students, alumni, faculty, staff, recruiters) to help each other, keep in touch, facilitate networking, share opportunities, exchange advice, promote education, and foster professional integration, employment, and careers. The site and its services are provided by the "AlumnForce" application published by the company MEVIA, a simplified joint-stock company with a capital of €11,300, registered in the Nanterre Trade and Companies Register under number B 501 609 143, whose registered office is located at 93-97 rue Eugène Caron, 92400 Courbevoie, France.  

The purpose of these general terms of use is to govern access to and the terms of use of the Site. We invite you to read them carefully.


 By activating your Account, requesting an Account, making a reservation for an event, or making a purchase on the Site, you acknowledge having read and accepted these general terms of use in their entirety.

Definitions

Terms beginning with a capital letter in the GTU have the following meaning (unless expressly stated otherwise):

  • Site means the website of UNIVERSITÉ CÔTE D’AZUR  accessible at the address HTTPS://LINK.UNIVCOTEDAZUR.FR giving access to the network Services;
  • Users mean the members who can access the services via an Account (students, alumni, faculty, staff, recruiters), individuals registering for an event, and Administrators. For each type of User, access to services may be limited according to the choices of the Administrators.
  • Administrators mean individuals, whether employed by UNIVERSITÉ CÔTE D’AZUR or not, authorized to use the Modules of the AlumnForce application for professional or management purposes: they have access to an Account allowing them to configure the Modules and to set up or perform actions on User Accounts;
  • Account means a valid account giving access to the Site Services;
  • Content means any content that Users can upload and access from the site, including but not limited to, articles, events, directories, profile sheets with Personal Data depending on the privacy settings each User has configured in their preferences;
  • Personal Data means any personal data relating to a natural person who is or could be identified;
  • Modules mean the management applications for a private professional social network developed by AlumnForce and accessible as "software as a service" (SaaS);
  • Privacy Policy means the document established by UNIVERSITÉ CÔTE D’AZUR presenting its processing of Users' Personal Data and defining their corresponding rights;
  • Services mean the provision of Modules and additional services that may be provided upon request from UNIVERSITÉ CÔTE D’AZUR by AlumnForce, including configuration, support, or training, etc.;

Scope of the General Terms of Use

These general terms of use ("GTU") apply to any use of and access to the Site Services. They are validated electronically by the User upon activation of their Account and upon each modification of the GTU. The GTU are accessible at any time on the Site. The professional social network is not freely accessible. Access is reserved for network Users who have accepted the GTU and have an Account with a username and password.

Users acknowledge having read and understood the GTU and agree to be bound by them.

UNIVERSITÉ CÔTE D’AZUR reserves the right to modify the GTU at any time by notifying Users of any new version by email, who undertake to review these modifications.

Description of services provided by UNIVERSITÉ CÔTE D’AZUR

 UNIVERSITÉ CÔTE D’AZUR offers its members the following services:

  • A participatory network information and sharing service (news, events, discussions, newsletters, activity walls, comments, internal messaging, notifications, sharing to social networks, etc.)
  • A directory of User members with access to User profiles
  • A networking service between User members via internal messaging
  • A job board (service for disseminating job, internship, work-study offers…)
  • A participatory Groups service
  • An online donation, ticketing, journal subscription, and product purchase service
  • A deals, projects, and announcements service
  • A mentoring sponsorship service
  • A dematerialized internship agreement management service

All these services aim to bring together members of UNIVERSITÉ CÔTE D’AZUR to foster networking, mutual support, professional integration, and careers.


Access to services

The User of the site acknowledges having the necessary skills and means to access this site and having verified that the computer configuration used contains no viruses and is in perfect working order.

To benefit from network access, the User must be an alumnus, student, faculty member, or staff of UNIVERSITÉ CÔTE D’AZUR and have an active email address to activate their account and participate in the network. Their Account must have been previously created by an Administrator.

Anonymous visitors can access the site, view public articles and events, but cannot visit profiles, post comments, or participate in discussions. They may have access to register for events open to the public. In this case, they must accept the GTU to reserve their participation in this type of event and provide at least their first name, last name, and an active email.

Users of the recruiter or partner company representative type may join the network with restricted access to post job offers. These Accounts must be validated or created beforehand by an Administrator.

The User agrees not to use a pseudonym or email address that could infringe on the rights of third parties (surname, brand name, etc.), nor to impersonate a name, company name, or registered trademark.

Upon first login, the User must accept and validate the GTU, specify their password, and update their Account preferences regarding notifications and profile information privacy levels. Their Account may be deactivated and then deleted by an Administrator if it remains inactive for more than two years.


Administrators

Administrators declare that they are authorized to use the Services and have accepted the GTU on behalf of UNIVERSITÉ CÔTE D’AZUR. The Administrator configures the User Account settings via imports or individual additions. They configure and validate access requests from Users such as representatives of partner companies. The Administrator can send access details to each User. The Administrator can block a User's access if necessary.


User Accounts

The User can access the Services once the GTU are validated and only if the User's Account has been previously created by an Administrator with at least a First Name, Last Name, and an active Email. The User will need to provide at least one active email and specify the password to log in for the first time. They can modify and update their email and password at any time from their Account management. They will then access their User menu to access the different Modules of the platform corresponding to the authorized access according to their User type.


Password

The password associated with each Account is strictly personal and confidential and must not be shared with third parties. Users are responsible for the loss or theft of their password. We recommend that Users change their passwords regularly and choose complex passwords of at least 8 characters including letters, numbers, and special characters. Each User is free to change their password at any time from their Account management.


Use of services

The texts, software, images, videos, data, and any other work present on this site are protected by intellectual property law. The User of the site agrees not to reproduce them without the express consent of UNIVERSITÉ CÔTE D’AZUR. The User agrees not to copy or sell all or part of the Modules and the Site.

The User guarantees to UNIVERSITÉ CÔTE D’AZUR that they have the necessary rights, including all intellectual property rights on the articles, testimonials, comments, images, and data of any kind that they disclose on this Site, allowing them to grant the rights transferred herein.

The User expressly and freely consents that their testimonials and comments may be reproduced and/or represented in communication materials intended for the promotion of UNIVERSITÉ CÔTE D’AZUR throughout the legal duration of protection of these comments and testimonials.

Messages and images posted are the responsibility of their author, who agrees to assume all related responsibilities and consequences. In particular, the author of the message guarantees UNIVERSITÉ CÔTE D’AZUR against all actions brought by third parties having as cause, basis, or origin the content of their message. They therefore agree to bear the amount of any convictions and related defense costs, or any transactional indemnity that would be due in the context of the dispute. The site representatives decline all responsibility for the content of messages posted by users.

The User is responsible for the Account assigned to them from the date of its activation. It is their duty to keep their Account secret and not to disclose it to any other person. The User is solely responsible for the use made of their Account, as well as for the Content published via their Account.

For the respect and well-being of all, the following are prohibited: messages of an insulting, offensive, obscene, or defamatory nature, content infringing the rights of others, violent statements or inciting racism, pornography, pedophilia, or crimes and offenses, misappropriation of the site for propaganda, commercial prospecting, or political purposes.

Users can report any disturbing message to the Administrator. The Administrator may delete without notice any message not respecting the conditions mentioned above.

UNIVERSITÉ CÔTE D’AZUR reserves the right, without justification, to refuse access to the Site to any Visitor or User who has not respected these terms of use or the applicable law. In the event that, according to the Visitor or User concerned, this is an error, the latter may contact UNIVERSITÉ CÔTE D’AZUR.


Participation in Groups

The Site allows Users, if the Groups Module is active, to create restricted circles within the network. They can organize themselves into groups, for example around a city or region or a professional theme. The members of each group can thus have access to articles, events, forums, media, and a directory specific to their group. Each group and its members must respect the provisions of these GTU.


Posting job offers

All Users of the Site who can post a job offer agree not to use prohibited or discriminatory criteria, including the following criteria: origin, sex, morals, sexual orientation or identity, age, family situation or pregnancy, genetic characteristics, belonging or not belonging, real or supposed, to an ethnic group, nation or race, political opinions, trade union or mutualist activities, religious beliefs, physical appearance, etc. (Art. L 1132-1, L 1142-1, L 5531-2 of the Labor Code).


Personal data protection and privacy policy

The controller of the personal data referred to herein is UNIVERSITÉ CÔTE D’AZUR.

You can find the information notices directly on the platform in the "Help" tab.

The initially integrated data concerning Users on the Site comes from UNIVERSITÉ CÔTE D’AZUR. This data is necessary to obtain an Account and access to the services. This includes at least First Name, Last Name, Email, and academic background.

Other data is optionally updated by the Users themselves from their profile in order to present their expertise and projects to other Users for the purpose of interaction and creating opportunities for exchange, networking, and generating statistics on professional mobility:

- Profile picture

- Presentation

- Personal contact details (phone, mobile, personal email(s), primary and secondary address), date of birth, marital name, family status

- Current employment and professional contact details (position, job title, company, sector type)

- Previous employment(s)

- Current situation and professional wishes
 - Acquired skills and languages spoken

- Additional training

- Associative activities and centers of interest

- Curriculum vitae (via uploaded file or generated from previous information)

The identity of Users is only publicly visible if the User has activated their public profile or Public CV. Each User is free to activate or deactivate their public profile at any time.

The identity of Users (First Name, Last Name, Photo, City, Country, Position, Company) is visible to other Users from the Directory (list and map view) and from any interaction on the professional social network through an activity or participation by the User in an article, event, comment, group, or discussion.

The information collected from network Users through their profile and forms can only be consulted by other network Users (students, alumni, staff, faculty, authorized recruiters, Administrators). Users via their privacy management can limit access to their profile information based on the User type.

Users of the Recruiter type or persons representing a partner company provide the following data for Account creation:

- Title, First Name, Last Name, Email, Position in the company

- Company name and company address

External visitors to the network who register for an event must provide the following minimum data:

- First Name, Last Name, Email

and depending on certain events, the following data:

- Address, Phone, Mobile, Date of birth, Current position, Company, Professional address, Professional email

In the context of payment for a service on the Site (ticket for an event, membership fees, donation, or subscription), we will ask you to indicate the delivery and billing address information in order to create an order and an associated receipt. We do not store any bank card or bank account details; this information is processed by our online payment processing provider.

When you use the Site, we automatically collect information, including personal information, about the services you use and how you use them. This information is necessary for the proper execution of the agreement between you and us, for us to comply with legal obligations, and given our legitimate interest in being able to provide and improve the features of the Site:
- geolocation information: when you use certain features of the Site, we may collect information about your location, using your IP address or your mobile device's GPS, to offer you a better user experience. Most mobile devices allow you to control or disable the use of location services in applications from the device's settings menu.
- usage information: we collect information about your interactions on the Site, such as pages or content you view, your searches, purchases you have made, and other actions on the site in order to improve the Site Services.
 - log data and device information: we automatically collect log data and device information when you access the Site. This information includes, among other things: information about how you used the site, IP address, access dates and times, hardware and software information, device information, device event data, unique identifiers, crash data, cookies. This information allows us, in particular, to improve the performance of the Site and the quality of the Services, but also to detect and prevent fraud, spam, abuse, security incidents, and other harmful activities.

Users agree to always provide truthful and accurate Personal Data and to update it if necessary so that it remains complete and accurate. We will regularly request you to do so.

A User's information contained in the professional network database remains the property of that User. In accordance with current European regulations, Site Users have the following rights:

- right of access (Article 15 GDPR) and rectification (Article 16 GDPR), updating, completeness of User data

- right to erasure of Users' personal data (Article 17 GDPR),

- right to withdraw consent at any time (Article 13-2c GDPR)

- right to restriction of processing of User data (Article 18 GDPR)

- right to object to the processing of User data (Article 21 GDPR)

- right to data portability for the data that Users have provided (Article 20 GDPR)

Any network User can freely modify or delete the information they have entered themselves on the network. They can also demand that the information concerning them provided by UNIVERSITÉ CÔTE D’AZUR be rectified, completed, clarified, updated, or deleted. No personal information is collected without the knowledge of network members.

You can exercise this right:


UNIVERSITÉ CÔTE D’AZUR is solely authorized to hold the data and undertakes not to resell or transmit it to third parties, and that this information will not be processed for purposes other than its online publication within the Site. UNIVERSITÉ CÔTE D’AZUR is likely to process your personal data in the context of your access and/or use of the Site. This includes, in particular, data collected by UNIVERSITÉ CÔTE D’AZUR when a User activates their Account or updates information on the User's profile.

However, here are the various purposes of the processing planned by UNIVERSITÉ CÔTE D’AZUR 

1 - Dematerialization of internship agreements, from the collection of administrative data (from APOGÉE) to the finalized drafting leading to a tripartite electronic signature: institution, student, host organization.

2 - The student accepts the use of their data related to the dematerialization of their agreements to feed the internship history.

3 - Promote the professional integration of students (in accordance with the obligations of Higher Education and Research Establishments) by making available to them, through a Career Center, targeted internship or job offers based on their areas of interest.

4 - Offer a dedicated social network for students and alumni to facilitate the process of professional integration and create an active community within the institution 

5 - Have a reliable means of contact with graduating students in order to contribute to surveys by the OVE-IP service of UNIVERSITÉ CÔTE D'AZUR.


The Site of  UNIVERSITÉ CÔTE D’AZUR is protected by the provisions of the Intellectual Property Code, particularly regarding the protection of databases. Any person who creates a file or database with the information present on the Site UNIVERSITÉ CÔTE D’AZUR, and who makes it available to a third party, for a fee or free of charge, without the agreement of UNIVERSITÉ CÔTE D’AZUR and in violation of the GTU, would be exposed to the civil and/or criminal penalties provided for by the Intellectual Property Code.

UNIVERSITÉ CÔTE D’AZUR reserves the right to evolve this Privacy Policy in order to comply with changes in applicable laws and regulations. The changes made will be notified via our Site or by email, as far as possible, at least thirty days before they come into effect.


Data retention period

We retain your data only for the time necessary for the purposes pursued, in accordance with legal requirements.

Security

The User of the Site acknowledges being informed of the risks associated with the use of the Internet and networks, and in particular the fact that information relating to personal data concerning them may be copied or intercepted. The User of the Site acknowledges accepting these risks, for which UNIVERSITÉ CÔTE D’AZUR cannot under any circumstances be held responsible. UNIVERSITÉ CÔTE D’AZUR implements all technical and human resources to ensure a permanent level of security in accordance with the current state of the art in this field and to prevent attacks by malicious persons. Some of the protective measures we use to protect your information are firewalls and encrypted data transmission using SSL/HTTPS technology.


Guarantee

UNIVERSITÉ CÔTE D’AZUR commits to taking particular care regarding the truthfulness of the information exchanged on the Site and to keeping it regularly updated. However, errors or omissions may occur. In this case, we thank you for reporting them to us so that we can make the necessary corrections. During its checks and occasional interventions, the Site Administrator undertakes not to modify the Content in a way that could change its meaning. However, they reserve the right to move Content if they notice a flagrant error in thematic classification.

UNIVERSITÉ CÔTE D’AZUR does not guarantee uninterrupted access to the Site, especially in case of interventions for maintenance, repairs, or disruptions of internet connections. It cannot be held responsible for technical failures and related data loss, nor for any other indirect damage occurring during or related to the use of the site.


Applicable Law 

The GTU is governed solely by French law. Any dispute arising from the validity, interpretation and/or execution, termination, breach of these GTU and after failure of any conciliation, will be submitted to the Court of Appeal of Aix en Provence.
